1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of Just Music GmbH (hereinafter referred to as "Provider") apply to the participation in the Provider's bonus points programme "JustPoints" by a consumer (hereinafter referred to as "Customer"). The inclusion of the customer's own terms and conditions is hereby objected to unless otherwise agreed.
1.2 A consumer within the meaning of these GTC and § 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.
1.3 An entrepreneur within the meaning of these GTC and § 14 of the German Civil Code (BGB) is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity. Entrepreneurs cannot participate in the JustPoints program.
2.1 Participation in the JustPoints program requires a separate registration. The prerequisite is that the customer sets up a free customer account in the online shop or in the Provider's store, in which the collected JustPoints are stored. Upon successful creation of the customer account, the customer participates in the JustPoints program of the Provider after registration.
2.2 The Customer can set up its registration for the JustPoints program using the online form provided by the Provider for this purpose. Sending the registration data constitutes the customer's offer to conclude a contract of use, which the Provider may accept but is not obliged to accept. The Provider may accept the Customer's offer within 48 hours of receipt of the application by means of an electronically transmitted registration confirmation or by activating the JustPoints program. If the Provider does not accept the Customer's contractual offer within the aforementioned period, this shall be deemed to be a rejection of the offer. Alternatively, the customer may commission his/her registration with an employee at the local JustMusic store.
2.3 The data requested during registration must be provided by the customer in full and correctly. The customer is obliged to keep this data up to date at all times. As a matter of principle, the Provider does not check the transmitted data for correctness and completeness.
2.4 Each customer may only set up one JustPoints account for himself. His/her entitlement to participate in the JustPoints program applies only to him/her personally and is non-transferable. This also applies to bonus points collected by the customer.
3.1 When ordering goods via the Provider's online shop or when purchasing goods in our JustMusic store, customers will receive bonus points credited to their customer account. The credit will be made automatically as soon as the order with the Provider has the status "delivered". The credited points are activated after 40 days and are only available for use after this period.
3.2 Bonus points are only credited to the customer account via which the order was placed. It is not possible to transfer bonus points to other customer accounts in the Provider's online shop.
3.3 Unless otherwise stated, the customer receives one bonus point for each full euro of the gross order value. Any additional shipping costs incurred shall not be taken into account. In the case of special promotions, bonus points may also be credited to a different extent, which will be specifically communicated to the customer in the context of the relevant promotion.
3.4 Unless otherwise stated, the customer shall receive 25 bonus points for each product evaluation in the Provider's online shop. In the case of special promotions, bonus points may also be credited to a different extent, which will be specifically communicated to the customer in the context of the relevant promotion.
3.5 Unless otherwise stated, the customer shall receive 250 bonus points once for subscribing to the JustMusic e-mail newsletter. In the case of special promotions, bonus points may also be credited in a different amount, which will be specifically communicated to the customer in the context of the relevant promotion.
3.6 The Provider reserves the right to temporarily suspend its JustPoints program or to change the modalities thereof if other benefits or discounts are granted or if goods are offered as part of special promotions or special events.
4.1 Bonus points can be used in the online shop or in the store of the Provider and only for the items designated for this purpose by the Provider at the point values notified by the Provider in each case.
4.2 Bonus points can be used within a period of 24 months from the date on which the credit is issued to the customer's account. After expiry of the aforementioned period, the bonus points lose their validity.
4.3 Bonus points can only be used before completing an order transaction. Subsequent offsetting against an already completed purchase is not possible.
4.4 The points credit will neither be paid out, refunded, exchanged nor will interest be paid on it.
4.5 Bonus points are non-transferable and can only be redeemed by the holder of the associated customer account.
5.1 The customer's bonus points are stored in the customer account and can be viewed by the customer at any time via his customer account in the Provider's online shop. The collected bonus points and the information on which they are based will be used to manage the bonus program and for marketing purposes.
5.2 Objections to the correctness or completeness of the stored points balance must be raised by the customer in text form with the Provider within one month of becoming aware of them. If the customer fails to raise any objections within the aforementioned period, this shall be deemed to be approval of the stored points credit.
6.1 The contract of use (and thus also the contract for participation in the JustPoints program) is concluded for an indefinite period and may be terminated by the customer at any time without observing a notice period. The Provider may terminate the contract by giving four weeks' notice.
6.2 The right to extraordinary termination for good cause remains unaffected. Good cause shall be deemed to exist if the terminating party, taking into account all circumstances of the individual case and weighing the interests of both parties, cannot reasonably be expected to continue the contractual relationship until the agreed termination or until the expiry of a notice period.
6.3 Termination may be effected written, or on the part of the customer also by deregistration from the JustPoints program or by deletion of his customer account.
6.4 If the Customer terminates his Customer Account with immediate effect or deregisters from the JustPoints Program with immediate effect, the bonus points collected by the Customer shall expire without the Provider having to pay any compensation.
6.5 If the contract is terminated by the Provider, the Customer shall be given the opportunity to use his accumulated bonus points in accordance with the above provisions until the termination of the usage contract, unless the Customer has culpably given cause for termination for good cause.
7.1 The Provider is entitled to terminate the contract with 6 months' notice. This does not affect the right of the Provider and the Customer to terminate the contract for good cause in writing, including by e-mail.
7.2 If the JustPoints program is discontinued by the Provider, the Customer may use the bonus points collected up to the time of discontinuation in accordance with the above provisions within a period of four weeks from the termination of the program. Otherwise, the collected bonus points will expire without the Provider having to pay any compensation.
8.1 The Provider reserves the right to change the content of its JustPoints program and/or these GTC at any time without stating reasons, unless this is unreasonable for the Customer. The Provider shall notify the Customer of any such changes in text form in due time. If the customer does not object to the changes within a period of four weeks after notification, the changes shall be deemed accepted by the customer. In the notification, the Provider shall inform the customer of his right of objection and the significance of the objection period. If the customer objects to the changes within the aforementioned period, the contractual relationship shall continue to exist under the original conditions.
8.2 Furthermore, the Provider reserves the right to change the content of its JustPoints program and/or these GTC,
8.3 The customer's right of termination remains unaffected.
9.1 The law of the Federal Republic of Germany shall apply to all legal relationships between the parties. In the case of consumers, this choice of law shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.
